These Terms of Service ("Terms") govern your access to and use of the CurrencyBlazer website, reports, and related services (collectively, the "Services") provided by CurrencyBlazer ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
CurrencyBlazer provides independent foreign exchange (FX) benchmarking and analysis services. We analyse your historical FX transaction data against published mid-market reference rates to identify and quantify execution variance.
Our Services include:
You must be at least 18 years old and have the authority to bind the entity you represent to these Terms. By using our Services, you represent and warrant that you have such authority and that you are providing data you are authorised to share.
To use our benchmarking services, you must provide a valid business email address, your company name, and a CSV file containing your FX transaction data. You are responsible for:
Upon receipt of a valid transaction file, we will endeavour to deliver your benchmark analysis report within five (5) business days. Delivery timelines may vary based on data volume, data quality, and the number of currency corridors to be analysed.
We reserve the right to reject or return data submissions that are incomplete, corrupted, in unsupported formats, or that we reasonably believe to be fraudulent or otherwise non-genuine.
No fees arise from accessing this website or from an initial scoping conversation. All commercial terms applicable to an engagement — including scope, fee basis, invoicing, and payment terms — are set out exclusively in a separate written Engagement Agreement executed by both parties before any analytical work begins. No fee obligation arises under these Terms in the absence of such an executed agreement.
CurrencyBlazer receives no commission, referral fee, rebate, or other consideration from any bank, broker, or payments provider in connection with any engagement or any decision a client takes following one.
Your Data: You retain all ownership rights to your transaction data. We claim no ownership interest in any data you submit.
Our Reports: The analysis reports, methodologies, algorithms, and analytical frameworks we produce are our proprietary intellectual property. You are granted a non-exclusive, non-transferable licence to use your analysis report for your internal business purposes, including board presentations, provider negotiations, and treasury reviews.
Restrictions: You may not resell, redistribute, publicly publish, or create derivative commercial products from our reports or methodologies without our prior written consent.
Not Financial Advice: CurrencyBlazer provides data analytics and benchmarking services only. Nothing in our reports, website, communications, or Services constitutes financial advice, investment advice, legal advice, or a recommendation to engage in any specific financial transaction.
No Guarantee of Outcome: Our analysis quantifies historical execution variance. It does not guarantee any future outcome. Whether any variance identified can be reduced depends on your provider's willingness to renegotiate, market conditions, and your own commercial decisions — all of which are outside our control.
Benchmark Data: Mid-market rate benchmarks are sourced from an independent third-party FX reference-rate data provider that is not a bank, broker, or execution venue and has no commercial relationship with any provider whose execution we measure. These are published reference rates; we do not hold or claim access to interbank feeds, trading-venue tick data, or any provider's internal pricing. We do not warrant the absolute accuracy of third-party data, though we use commercially reasonable efforts to ensure data integrity.
To the maximum extent permitted by applicable law, CurrencyBlazer's total aggregate liability arising out of or relating to these Terms or your use of the Services shall not exceed the total fees actually paid by you to CurrencyBlazer in the twelve (12) months preceding the claim.
In no event shall CurrencyBlazer be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, regardless of the theory of liability.
You agree to indemnify, defend, and hold harmless CurrencyBlazer and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your breach of these Terms, or your violation of any applicable law.
Your data is processed in accordance with our Privacy Policy and, where applicable, the data-handling terms of the signed engagement agreement (including a data processing addendum where applicable). We are committed to GDPR, CCPA, and applicable data protection compliance. See our Privacy Policy and your engagement agreement for full details.
These Terms remain in effect for as long as you use our Services. Either party may terminate the relationship at any time by providing written notice. Upon termination, our obligations regarding data deletion (as set forth in the engagement agreement) will be honoured, and any accrued payment obligations under an executed Engagement Agreement will survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings held in Wilmington, Delaware.
We may update these Terms from time to time. Material changes will be communicated via email to active clients and posted on this page with an updated effective date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
