Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CurrencyBlazer platform, website, reports, and related services (collectively, the "Services") provided by CurrencyBlazer ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

CurrencyBlazer provides independent foreign exchange (FX) benchmarking and audit services. Our platform analyses your historical FX transaction data against independent mid-market rate benchmarks to identify execution variance and potential cost optimisation opportunities.

You must be at least 18 years old and have the authority to bind the entity you represent to these Terms. By using our Services, you represent and warrant that you have such authority and that you are providing data you are authorised to share.

To use our audit services, you must provide a valid business email address, your company name, and a CSV file containing your FX transaction data. You are responsible for:

4. Service Delivery

Upon receipt of a valid transaction file, we will endeavour to deliver your benchmark report within five (5) business days. Delivery timelines may vary based on data volume, data quality, and the number of currency corridors to be analysed.

We reserve the right to reject or return data submissions that are incomplete, corrupted, in unsupported formats, or that we reasonably believe to be fraudulent or otherwise non-genuine.

5. Fees and Payment

5.1 Free Audit Report

The initial benchmark audit is provided at no upfront cost. If our analysis identifies no material deviation between your executed rates and independent mid-market benchmarks, the report is yours to keep at no charge.

5.2 Gain Share Model

Where our analysis identifies material execution variance and you elect to act on our recommendations (including provider renegotiation, corridor optimisation, or provider switching), our fee is structured as a contingency-based "Gain Share" — a percentage of verified, realised savings over a 24-month period.

The specific Gain Share percentage (typically 15%–25%) will be set forth in a separate Engagement Agreement executed by both parties before any recovery or optimisation work begins. No fees are owed until savings are independently verified and confirmed by your finance team.

5.3 No Hidden Fees

There are no setup fees, subscription fees, platform fees, or data processing fees. Our revenue is entirely contingent on delivering measurable savings to your business.

6. Intellectual Property

Your Data: You retain all ownership rights to your transaction data. We claim no ownership interest in any data you submit.

Our Reports: The audit reports, methodologies, algorithms, and analytical frameworks we produce are our proprietary intellectual property. You are granted a non-exclusive, non-transferable licence to use your audit report for your internal business purposes, including board presentations, provider negotiations, and treasury reviews.

Restrictions: You may not resell, redistribute, publicly publish, or create derivative commercial products from our reports or methodologies without our prior written consent.

7. Disclaimers

Not Financial Advice: CurrencyBlazer provides data analytics and benchmarking services only. Nothing in our reports, website, communications, or Services constitutes financial advice, investment advice, legal advice, or a recommendation to engage in any specific financial transaction.

No Guarantee of Savings: While our analysis identifies historical execution variance, past results do not guarantee future savings. Actual savings depend on your provider's willingness to renegotiate, market conditions, and your commercial decisions.

Benchmark Data: Mid-market rate benchmarks are sourced from Fixer.io, an independent third-party data provider. We do not warrant the absolute accuracy of third-party data, though we use commercially reasonable efforts to ensure data integrity.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CurrencyBlazer's total aggregate liability arising out of or relating to these Terms or your use of the Services shall not exceed the total fees actually paid by you to CurrencyBlazer in the twelve (12) months preceding the claim.

In no event shall CurrencyBlazer be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, regardless of the theory of liability.

9. Indemnification

You agree to indemnify, defend, and hold harmless CurrencyBlazer and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your breach of these Terms, or your violation of any applicable law.

10. Data Protection

Your data is processed in accordance with our Privacy Policy and, where applicable, a signed Data Processing Agreement. We are committed to GDPR, CCPA, and applicable data protection compliance. See our Privacy Policy and DPA for full details.

11. Term and Termination

These Terms remain in effect for as long as you use our Services. Either party may terminate the relationship at any time by providing written notice. Upon termination, our obligations regarding data deletion (as set forth in our DPA) will be honoured, and any accrued payment obligations under an executed Engagement Agreement will survive termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings held in Wilmington, Delaware.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to active clients and posted on this page with an updated effective date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
